The article provides an historical overview of the Economic Espionage Act of 1996, reviews its provisions, and details the factors that have contributed to the recent growth of trade secret prosecutions under the Act. Mr. Lincenberg and Mr. Shakow go on to describe and analyze proven strategies – and a number of more novel ones – used to defend against economic espionage and trade secret theft charges in recent years.
