Bird Marella principal Gary S. Lincenberg and associate Michael C. Landman were featured speakers at the 38th Annual National Institute on White Collar Crime, hosted by the American Bar Association’s Criminal Justice Section.
Mr. Lincenberg, former National Co-Chair of the ABA’s White Collar Crime Committee, moderated the plenary panel on the role of general counsel within government investigations. The group, consisting of in-house counsel from Woodward, Inc., the University of Southern California, Molson Coors Beverage Company, and the University of Pittsburgh Medical Center, discussed dealing with data breaches, the impact of social media on the conduct of internal investigations, recent cases involving privilege waivers, and voluntary disclosures.
Mr. Landman, a former federal prosecutor for the U.S. Department of Justice’s Tax Division, served on a panel that included current and former prosecutors. The panel examined the unique issues in criminal tax investigations and prosecutions, including those related to pre-indictment tax conferences, substantive/procedural challenges to tax loss, and restitution. Additionally, the Institute featured Mr. Landman’s article, Five Years Since Marinello v. United States, which examines the impact of the Supreme Court’s landmark decision concerning violations of Title 26, United States Code Section 7212(a), which prohibits obstructing the due administration of the IRS.
