After almost 30 days of evidentiary hearings, Bird Marella won a complete dismissal of all charges against Kareem Ahmed, the lead defendant in a 17-defendant, $300 million healthcare fraud prosecution in Orange County, California.
Principals Benjamin Gluck and Nicole Rodriguez Van Dyk led the defense, cross-examining the Deputy District Attorney and investigators, and establishing that the District Attorney’s Office had invaded the attorney-client privilege. Mr. Gluck and Ms. Van Dyk also successfully retrieved the client’s frozen assets. They previously achieved a dismissal in the same matter by appealing grand jury defects to the California Supreme Court – meaning the case cannot be refiled.
Mr. Gluck shared with the Orange County Register: “We’re grateful for the attention that Judge Hanson gave to the issue, and, obviously, we’re pleased with the outcome. Apart from the procedural errors in this case, on the underlying issues we contend Mr. Ahmed never did anything wrong.”
