Bird Marella attorneys Paul Chan and Thomas Freeman prevailed on appeal on behalf of the former owner of a General Motors dealership who was sued by the purchaser of his business. The dealership’s new owner sued for damages after assuming day-to-day management of the business claiming that it failed because of fraud. Bird Marella successfully argued that the purchaser would have failed and incurred the same losses regardless of their allegations.
The trial court granted summary judgment for Bird Marella’s client, on the grounds that the purchaser could never prove fraud because he could not prove causation of damages. The California Court of Appeal for the Third Appellate District agreed, affirming the trial court’s order and granted summary judgment in the client’s favor.
