Bird Marella Wins Affirmance of Defense Verdict in Breach of Contract Suit

Ekwan Rhow, Fanxi Wang and Kate Shin won affirmance of a defense verdict for owners of an international sports apparel company in a breach of contract suit. Plaintiffs were business partners with the owners and sought millions in damages alleging the owners had committed fraud after the partnership was terminated. In May 2018, the Bird Marella defense team prevailed after a two-week jury trial in Los Angeles Superior Court, defeating both fraud and alter ego claims with the jury determining the owners were not liable for any amounts. On April 3, 2020, the California appellate court affirmed the trial court’s ruling.
