Bird Marella Principal Gary Lincenberg was featured in the article, “Increase of Economic Espionage Act Filings” published by Lawyer Monthly (September 2013), discussing precautionary steps businesses should take in preventing intellectual property theft. Mr. Lincenberg predicts a substantial increase of Economic Espionage Act filings based on increasingly sophisticated methods of detecting economic espionage, and the expanded cooperation of U.S. and foreign law enforcement agencies.
Mr. Lincenberg advises U.S. companies to protect themselves by securing their real and intellectual property, including reviewing and updating their written confidentiality policies, conducting employee trainings regarding confidentiality of trade secrets, requiring employees to sign confidentiality agreements and implementing reasonable security measures. Mr. Lincenberg says, “The goal need not be to achieve total lockdown, but rather to put reasonable roadblocks to theft of trade secret information and alert potential IP thieves.”
