Bird Marella partner William Johnston is quoted in the May 15, 2024 Bloomberg article, “Boeing Has Four Weeks to Stop Possible Prosecution Over Crashes.”
The article discusses the possible consequences of Boeing’s alleged breach of its 2021 deferred prosecution agreement (DPA) with the Department of Justice following a new federal probe into manufacturing and safety issues at the company. The DPA was reached in connection with the 2018 and 2019 crashes of two Boeing 737 Max 8 jets. The new probe was launched after a January 2024 mid-air blowout of a door plug on a Boeing 737 Max 9 jet flown by Alaska Airlines.
Mr. Johnston, who previously served as Assistant Chief at the Department of Justice’s Fraud Section, discussed the factors that would have led Boeing to the brink of being found in breach, and the potential impact a monitorship would have on the company.
