Bird Marella attorneys Timothy Yoo and Christopher Jumin Lee won a judgment in favor of a joint defense group comprised of some of South Korea’s largest media companies – Kakao Entertainment, Genie Music, NHN Bugs, TJ Media, Keum Young, MBC, and TV Chosun – in a copyright-infringement lawsuit concerning the works of South Korean composer Jae-Ho Lee.
The Plaintiff alleged that these Korean companies had infringed his U.S. copyright by making Jae-Ho Lee’s music available on their streaming platforms, or by using them in Korean-language YouTube videos. Previously in June and September 2022, Mr. Yoo and Mr. Lee prevailed on their first and second motions to dismiss the action based on a lack of personal jurisdiction over the defendants. On November 18, 2022, the Honorable Dale S. Fischer agreed with their argument that uploading music to a globally available website such as YouTube was not sufficient to allow a U.S. Federal Court to exercise personal jurisdiction over Korean defendants and dismissed the Plaintiff’s complaint with prejudice.
